§ 1 Scope and Contracting Party

(1) These Terms and Conditions apply to the use of the website and services of Türkiye BioHealth, Gökhan Karahan, Fidan Sokak No: 50, Mustafa Kemal Paşa Mahallesi, Avcılar / Istanbul, Turkey – hereinafter referred to as "Provider".

(2) The Provider is based in Turkey. There is no branch, office, or representation in Germany or the European Union.

(3) Deviating terms of the user only become part of the contract if the Provider has expressly agreed in writing.

§ 2 Service Description – Information Platform

(1) This website is purely an information and contact platform. The Provider is NOT a medical facility, not a physician, not a clinic, and not a broker in the legal sense.

(2) The platform offers:

  • General information about medical treatment options in Turkey
  • Contact options to independent clinics in Istanbul
  • Non-binding initial consultation and forwarding of inquiries
  • Information about optional additional services (transfers, accommodation)

(3) The Provider does NOT perform any medical treatments and does NOT provide medical advice. All medical services are provided exclusively by independent, state-licensed clinics and their physicians in Turkey.

(4) A treatment contract is concluded exclusively between the patient and the respective clinic in Turkey. The Provider is NOT a party to this contract.

(5) No healing promises: This website contains no guarantees for treatment outcomes. Medical results depend on individual factors and cannot be guaranteed.

§ 3 No German or EU Involvement

(1) No German or EU company is involved in the services offered through this website.

(2) All treatments take place exclusively in Turkey.

(3) The domain was registered technically on behalf of the Provider. The domain registrant is not the operator or responsible for the content.

(4) No rights under German or European law are guaranteed.

§ 4 Contact and Contract Formation

(1) The presentation on the website does not constitute a legally binding offer but non-binding information.

(2) By contacting us, the user expresses a non-binding interest in information.

(3) All price information on this website are non-binding estimates.

(4) No contractual relationship with the Provider is established through contact.

§ 5 User Obligations and Responsibilities

(1) The user is solely responsible for:

  • The decision to undergo medical treatment abroad
  • Consulting their physician before traveling
  • Verifying their fitness to travel and health prerequisites
  • Obtaining adequate travel health insurance
  • Selecting the clinic and deciding for or against treatment

(2) The user confirms that all information provided is truthful.

§ 6 Costs and Payment

(1) Use of the information platform and contacting us is free of charge.

(2) Costs for medical treatments are agreed directly between the patient and the treating clinic.

(3) Optional additional services may be offered separately. Costs will be communicated transparently before booking.

§ 7 Disclaimer of Liability

(1) The Provider is NOT liable for:

  • The performance, quality, or outcome of medical treatments
  • Complications during or after treatment
  • Misdiagnoses or treatment errors by clinics
  • Dissatisfaction with treatment results
  • Consequential damages of any kind from medical treatments
  • Delays, cancellations, or changes by clinics
  • Services of third parties (hotels, transfer companies, etc.)

(2) Responsibility for medical treatment lies exclusively with the treating clinic.

(3) The Provider makes no healing promises and no guarantees for treatment outcomes.

(4) Use of the website and the decision for treatment are at the user's own risk.

§ 8 Cancellation

(1) Cancellation conditions for medical treatments are determined by the respective clinic.

(2) For booked additional services, the cancellation conditions of the respective service provider apply.

§ 9 Note on Right of Withdrawal

As the Provider is based in Turkey and is not an EU company, there is no right of withdrawal under EU consumer law. Turkish law applies to any contracts.

§ 10 Data Protection

Information on the processing of personal data can be found in our privacy policy.

Note: By contacting us, you consent to the transfer of your data to Turkey. Turkey is considered a third country without an EU adequacy decision.

§ 11 Applicable Law and Jurisdiction

(1) The law of the Republic of Turkey applies exclusively.

(2) Place of jurisdiction is Istanbul, Turkey.

(3) German or European law is not guaranteed.

§ 12 Final Provisions

(1) Should individual provisions of these terms be invalid, the remaining provisions shall remain unaffected.

(2) The Provider reserves the right to amend these terms at any time.

(3) By using the website, the user accepts these terms in their current version.
